These Terms of Service (“Terms”) govern your access to and use of the Fetchy website, mobile applications, iMessage application, products, software, and related services (collectively, the “Services”) provided by Fetchy App LLC (“Fetchy,” “we,” “us,” or “our”).
 

By accessing or using Fetchy, you agree to these Terms. If you do not agree, do not use the Services.
 

1. WHO WE ARE

Fetchy is a digital organization and productivity platform that helps users capture, organize, search, retrieve, and manage notes, ideas, bookmarks, tasks, links, uploads, and related content using intelligent organization systems and AI-powered features.

2. ELIGIBILITY

You must be at least 13 years old, or the minimum age required in your jurisdiction, to use Fetchy.
 

By using the Services, you represent and warrant that:

  • You are legally capable of entering into these Terms

  • You will comply with all applicable laws

  • You will not use the Services for unlawful or prohibited purposes
     

If you use Fetchy on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.
 

3. ACCOUNTS

To use certain features, you may need to create an account.

You agree to:

  • Provide accurate and complete information

  • Keep your login credentials secure

  • Notify us immediately of unauthorized access

  • Accept responsibility for activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

 

4. USER CONTENT

You retain ownership of content you upload, submit, type, store, or link through Fetchy (“User Content”).
 

By using the Services, you grant Fetchy a limited, non-exclusive, worldwide license to host, store, process, analyze, reproduce, and display User Content solely for the purpose of:

  • Operating the Services

  • Providing organization and retrieval features

  • Improving functionality and performance

  • Maintaining security and reliability
     

You represent and warrant that:

  • You own or have rights to your User Content

  • Your User Content does not violate any law or third-party rights

  • Your User Content does not contain unlawful, harmful, infringing, or abusive material
     

Fetchy does not claim ownership of your User Content.

 

5. AI FEATURES

Fetchy may use artificial intelligence (“AI”), machine learning systems, and automated technologies to:

  • Organize content

  • Generate tags and categories

  • Improve retrieval and search

  • Analyze relationships between information

  • Recommend actions or organization structures

  • Improve user experience and product functionality
     

AI-generated outputs may not always be accurate, complete, or reliable.
 

You acknowledge that:

  • AI systems can make mistakes

  • Fetchy does not guarantee accuracy of AI-generated results

  • You are responsible for reviewing important information before relying on it


The Services and AI-generated outputs are provided for informational and organizational purposes only and do not constitute legal, medical, financial, mental health, or professional advice.

 

You may not use the Services for high-risk activities where errors could lead to death, injury, legal liability, or significant financial harm, including medical diagnosis, legal determinations, credit decisions, or emergency services.

 

Fetchy may use trusted third-party AI providers and cloud infrastructure providers to process content as described in our Privacy Policy.

 

Fetchy does not use private User Content to train generalized public AI models unless explicitly disclosed to and consented to by users.
 

Fetchy may use aggregated and de-identified data to improve the Services, analytics, infrastructure, and AI functionality.

 

6. ACCEPTABLE USE

You agree not to:

  • Use Fetchy for unlawful purposes

  • Upload malicious code or harmful content

  • Attempt unauthorized access to systems or accounts

  • Reverse engineer or interfere with the Services

  • Use automated systems to abuse or overload the platform

  • Infringe intellectual property rights

  • Harass, abuse, or harm others

  • Use the Services to store or distribute illegal material

  • Violate export control or sanctions laws
     

We may investigate misuse of the Services and cooperate with law enforcement where legally required.

We may suspend or terminate access for violations of these Terms.

 

6A. BETA FEATURES

Certain features may be labeled alpha, beta, preview, experimental, or early-access features.

These features may:

  • Be incomplete

  • Contain bugs or errors

  • Change substantially

  • Be discontinued at any time

  • Have limited support or availability

Fetchy makes no guarantees regarding beta or experimental features.

 

7. PAYMENTS AND SUBSCRIPTIONS

Some features may require payment or subscription.
 

By purchasing paid Services, you agree:

  • To provide accurate billing information

  • To pay all applicable fees and taxes

  • That subscriptions may automatically renew unless canceled
     

Payments are securely processed through third-party payment providers such as Stripe.

Fetchy does not store full payment card information.
 

Unless otherwise stated:

  • Fees are non-refundable

  • Subscription changes may take effect at the next billing cycle

  • We may modify pricing with reasonable notice
     

You may cancel subscriptions according to the cancellation options provided in your account or app marketplace.

 

8. THIRD-PARTY SERVICES

Fetchy may integrate with or rely on third-party services, including:

  • Google services

  • Apple services

  • Authentication providers

  • Payment providers

  • Analytics providers

  • AI platforms

  • Cloud hosting providers
     

Your use of third-party services may also be subject to their own terms and privacy policies.

Fetchy is not responsible for third-party products or services.
 

9. INTELLECTUAL PROPERTY

The Services, including software, branding, logos, design, features, interfaces, and related intellectual property, are owned by Fetchy or its licensors and are protected by applicable laws.
 

Except as expressly permitted, you may not:

  • Copy

  • Modify

  • Distribute

  • Sell

  • Lease

  • Reverse engineer

  • Create derivative works from
     

any part of the Services.

 

10. FEEDBACK

If you provide suggestions, ideas, or feedback about Fetchy, you grant us the right to use that feedback without restriction or compensation.

 

11. TERMINATION

You may stop using Fetchy at any time.
 

We may suspend or terminate access to the Services if:

  • You violate these Terms

  • We suspect fraud, abuse, or security risks

  • Required by law

  • We discontinue the Services
     

Upon termination:

  • Your right to use the Services ends immediately

  • Certain data may remain in encrypted backups for legal, security, fraud prevention, disaster recovery, or operational purposes

  • Deleted content may persist temporarily in secure backup systems before permanent deletion

     

12. DISCLAIMERS

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FETCHY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

  • MERCHANTABILITY

  • FITNESS FOR A PARTICULAR PURPOSE

  • NON-INFRINGEMENT

  • ACCURACY

  • RELIABILITY

  • AVAILABILITY
     

We do not guarantee that:

  • The Services will be uninterrupted or error-free

  • AI-generated outputs will be accurate

  • Content will never be lost

  • Security breaches will never occur


13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FETCHY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND PARTNERS SHALL NOT BE LIABLE FOR:

  • INDIRECT DAMAGES

  • INCIDENTAL DAMAGES

  • CONSEQUENTIAL DAMAGES

  • LOST PROFITS

  • LOST DATA

  • BUSINESS INTERRUPTION

ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.
 

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

  • THE AMOUNT YOU PAID TO FETCHY IN THE PREVIOUS 12 MONTHS

  • $100 USD
     

Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.

 

14. INDEMNIFICATION

You agree to indemnify and hold harmless Fetchy and its affiliates, employees, contractors, and partners from claims, damages, liabilities, and expenses arising from:

  • Your use of the Services

  • Your User Content

  • Your violation of these Terms

  • Your violation of applicable laws or third-party rights

     

15. COPYRIGHT COMPLAINTS

If you believe content available through the Services infringes your intellectual property rights, please contact:

Please include sufficient detail for us to investigate the claim.

 

16. FORCE MAJEURE

Fetchy shall not be liable for delays or failures resulting from causes beyond its reasonable control, including internet outages, cloud provider failures, labor disputes, natural disasters, governmental actions, power failures, or cyberattacks.

 

17. APP STORE TERMS

If you download the Fetchy application through the Apple App Store or other app marketplaces, you acknowledge that:

  • Apple and app marketplace providers are not responsible for the Services

  • Your use of the application must comply with applicable marketplace terms

  • Apple and applicable marketplace providers are third-party beneficiaries of these Terms

     

18. PRIVACY

Your use of the Services is also governed by our Privacy Policy.

19. CHANGES TO THE SERVICES

We may modify, suspend, or discontinue portions of the Services at any time without liability.

We may also update these Terms periodically.

The updated version will include a revised “Last Updated” date.

Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

 

20. GOVERNING LAW

These Terms shall be governed by and interpreted under the laws of the State of California, without regard to conflict of law principles.

 

21. DISPUTE RESOLUTION

Before filing legal claims, you agree to first contact us and attempt to resolve disputes informally.
 

If disputes cannot be resolved informally, they may be resolved through binding arbitration or courts located in California, unless prohibited by applicable law.
 

To the maximum extent permitted by law, disputes must be brought only on an individual basis and not as part of a class action, consolidated action, or representative proceeding.

 

22. SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

 

23. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Fetchy regarding the Services and supersede prior agreements relating to the Services.
